Western philosophy’s relationship with prisons stretches from Plato’s own incarceration to the modern era of mass incarceration. Philosophy Imprisoned: The Love of Wisdom in the Age of Mass Incarceration draws together a broad range of philosophical thinkers, from both inside and outside prison walls, in the United States and beyond, who draw on a variety of critical perspectives (including phenomenology, deconstruction, and feminist theory) and historical and contemporary figures in philosophy (including Kant, Hegel, Foucault, and Angela Davis) to think about (...) prisons in this new historical era. All of these contributors have experiences within prison walls: some are or have been incarcerated, some have taught or are teaching in prisons, and all have been students of both philosophy and the carceral system. Incidental findings in research with human participants may have implications for a person’s present health or future health outcomes. Current guidelines focus on methods for handling and reporting incidental findings from biological test data but incidental findings might also arise from non-biological tests. This article presents three examples in which the results from non-biological test data can be predictive of future disease and should be disclosed to research participants. This article is partly an exercise in academic autobiography, seeking to make sense of the different ways in which I have applied semiotics to secular law on the one hand, Jewish law on the other. The very fact that it can be applied to both shows that its claims are methodological. But it also indicates a possible reformulation of the semiotic issues in philosophical terms: we may view the relationship between the semantic and pragmatic levels in terms of the relationship/balance (...) between certainty/truth (the semantic level) on the one hand and trust (the pragmatic level) on the other. In fall 2002, Paul Ellwood's Jackson Hole Group proposed “Heroic Pathways”—a healthcare reform concept that includes a voluntary system of portable, personal electronic medical records owned by patients and a health information pathway that is managed by patients and clinicians. This proposal, like so much of the innovative thinking in healthcare policy, is premised on the conviction that informed patients will drive healthcare changes in the near future.

Although this article uses Obergefell v Hodges (2015) as its frame, it aims to bring out some distinctive features of Justice Kennedy’s jurisprudence of dignity more broadly. There are two reasons why such an investigation is important. The first is important to those interested in the legal case. Indeed, in Dobbs v Jackson Women’s Health (2022), the Court now argues that the relevant ‘test’ for determining whether a right is protected under the Due Process Clause is whether the right (...) is found to be ‘deeply rooted’ in the nation’s history and tradition. This article aims to critique this decision, as well as originalist approaches to constitutional interpretation more broadly, and seeks to resurrect and reconstruct Kennedy’s jurisprudence of dignity that has undergirded (sometimes quietly) the expansion of civil rights protections to the LGBTQ+ community. The second reason this investigation is important is of interest to philosophers and legal historians. Dignity is a notoriously elusive concept, and much ink has been spilt trying to sort out the precise nature of its content and its boundaries. This article brings together the many (seemingly disparate) uses of dignity found across cases involving gay rights, abortion, and foreign sovereign immunity, and argues Kennedy effectively weaves these uses together in ways that may sharpen our understanding of dignity in both the philosophical and legal literatures. One of the most powerful tools for this form of silencing in the popular representation repertoire is the notion of an established genre. In US popular culture, creators and critics alike often position people who experience multiple layers of oppression as constitutively outside the expectations of existing genres. Their absence is attributable not simply to creator racism but also to that genre’s relationships to intersecting categories of difference and domination, such as race and gender. Beginning with the preponderance of representational violence in popular media, this article draws from existing work by feminists of color in order to model a critique of US representational precarity. To illustrate the political tensions in popular US culture, I stage my intervention into a medium whose industry has had particularly fraught struggles with representation: video gaming. The gaming industry’s struggles with representation in the wake of Gamergate are demonstrative of broader tensions in Black women’s representation in popular media. Thus, while I am focused on video games, I also intend this analysis to reflect on feminist studies of the relationship between genre and representation. I advance existing scholarship on video game representations of Blackness by theorizing violence enacted at the intersections of race, gender, and sexuality in game genres. Specifically, I position this intervention as a point of departure from TreaAndrea M. Russworm’s chapter in Gaming Representation: “Dystopian Blackness and the Limits of Racial Empathy in The Walking Dead and The Last of Us.”3 This chapter provides a compelling critique of the relationship between the dystopian game genre and Black representation, highlighting the lack of self-reflexivity in mass-market representations of Blackness. Expanding this project by taking another look at her objects of study—The Last of Us (2013– 2014) and Telltale’s The Walking Dead (2012)—I argue that taking Black women’s multiple jeopardy as foundational to the zombie dystopia genre offers a deeper look at the grammars of representational violence. My use of multiple jeopardy refers to Deborah K. King’s theorization of how multiple layers of oppression exponentially multiply individual disadvantages. Conceptual analysis is undergoing a revival in philosophy, and much of the credit goes to Frank Jackson. Jackson argues that conceptual analysis is needed as an integral component of so-called serious metaphysics and that it also does explanatory work in accounting for such phenomena as categorization, meaning change, communication, and linguistic understanding. He even goes so far as to argue that opponents of conceptual analysis are implicitly committed to it in practice. We show that he is wrong on (...) all of these points and that his case for conceptual analysis doesn't succeed. At the same time, we argue that the sorts of intuitions that figure in conceptual analysis may still have a significant role to play in philosophy. The Satisfaction With Life Scale (Diener, Emmons, Larsen, & Griffin, 1985) has been the dominant measure of life satisfaction since its creation more than 30 years ago. We sought to develop an improved measure that includes indirect indicators of life satisfaction (e.g., wishing to change one’s life) to increase the bandwidth of the measure and account for acquiescence bias. In 3 studies, we developed a 6-item measure of life satisfaction, the Riverside Life Satisfaction Scale, and obtained reliability and validity (...) evidence. Importantly, the Riverside Life Satisfaction Scale retained the high internal consistency, test– retest stability, and unidimensionality of the Satisfaction With Life Scale. In addition, the Riverside Life Satisfaction Scale correlated with other well-being measures, Big Five personality traits, values, and demographic information in expected ways. Although the Riverside Life Satisfaction Scale correlated highly with the Satisfaction With Life Scale, we believe it improves the Satisfaction With Life Scale by appropriately increasing construct breadth and reducing the potential for bias. Gilbert Harman’s famous principle of Clutter Avoidance commands that “one should not clutter one’s mind with trivialities". Many epistemologists have been inclined to accept Harman’s principle, or something like it. This is significant because the principle appears to have robust implications for our overall picture of epistemic normativity. Jane Friedman (2018) has recently argued that one potential implication is that there are no genuine purely evidential norms on belief revision. In this paper, we present some new objections to a suitably (...) formulated version of the clutter principle qua norm on belief revision. Moreover, we argue that the clutter principle is best understood as a norm on non-doxastic stages of inquiry. In our view, it is a norm of asking and considering questions rather than a norm of settling on an answer to a question by forming a belief. (shrink)

Specifically, Eric Watkins argues that a grasp of Leibnizian and anti-Leibnizian thought in eighteenth-century Germany helps one to see how the critical Kant argued for causal principles that have both metaphysical and epistemological elements. On this reading Kant's model of causality does not consist of events, but rather of substances endowed with causal powers that are exercised according to their natures and circumstances. Dobbs v. Jackson Women’s Health continues a trajectory of U.S. Supreme Court jurisprudence that undermines the normative foundation of public health — the idea that the state is obligated to provide a robust set of supports for healthcare services and the underlying social determinants of health. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for (...) reproductive health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. There is a long-standing debate in the philosophy of mind and philosophy of science regarding how best to interpret the relationship between neuroscience and psychology. It has traditionally been argued that either the two domains will evolve and change over time until they converge on a single unified account of human behaviour, or else that they will continue to work in isolation given that they identify properties and states that exist autonomously from one another. In this paper, I argue that (...) progress in psychology and neuroscience is contingent on the fact that both of these positions are false. Contra the convergence position, I argue that the theories of psychology and the theories of neuroscience are scientifically valuable as representational tools precisely because they cannot be integrated into a single account. However, contra the autonomy position, I propose that the theories of psychology and neuroscience are deeply dependent on one another for further refinement and improvement. In this respect, there is an irreconcilable codependence between psychology and neuroscience that is necessary for both domains to improve and progress. To date, emotion research has primarily focused on the experience and display of the emoter. However, of equal, if not more, importance is how such displays impact and guide the behavior of an observer. We incorporate a functionalist framework of emotion to examine the development of differential responding to discrete emotion, theorize on what may facilitate its development, and hypothesize the functions that may underlie such behavioral responses. Background: Many people participating in dementia research may lack capacity to give informed consent and the relationship between cognitive function and capacity remains unclear. Recent changes in the law reinforce the need for robust and reproducible methods of assessing capacity when recruiting people for research.Aims: To identify numbers of capacitous participants in a pragmatic randomised trial of dementia treatment; to assess characteristics associated with capacity; to describe a legally acceptable consent process for research.Methods: As part of a pragmatic randomised controlled (...) trial of Ginkgo biloba for mild-moderate dementia, we used a consenting algorithm that met the requirements of existing case law and the exigencies of the new Mental Capacity Act. We decided who had capacity to give informed consent for participation in the trial using this algorithm and sought predictors of capacity.Results: Most participants with mild-moderate dementia in this trial were unable to give informed consent according to the legal criteria. When adjusted for confounding, the Mini Mental State examination did not predict the presence of capacity.Conclusion: Cognitive testing alone is insufficient to assess the presence of capacity. Researchers and clinicians need to be aware of the challenging processes regarding capacity assessment. We outline a procedure which we believe meets the ethical and legal requirements. (shrink)

Although the terminology of Big Data has so far gained little traction in economics, the availability of unprecedentedly rich datasets and the need for new approaches – both epistemological and computational – to deal with them is an emerging issue for the discipline. Using interviews conducted with a cross-section of economists, this paper examines perspectives on Big Data across the discipline, the new types of data being used by researchers on economic issues, and the range of responses to this opportunity (...) amongst economists. First, we outline the areas in which it is being used, including the prediction and ‘nowcasting’ of economic trends; mapping and predicting influence in the context of marketing; and acting as a cheaper or more accurate substitute for existing types of data such as censuses or labour market data. We then analyse the broader current and potential contributions of Big Data to economics, such as the ways in which econometric methodology is being used to shed light on questions beyond economics, how Big Data is improving or changing economic models, and the kinds of collaborations arising around Big Data between economists and other disciplines. Given the difficulty of following, let alone mastering, the burgeoning scholarship on late antique philosophy, The New Cambridge Companion to Plotinus is a sample of the work of current, generally younger, scholars in the field, rather than a comprehensive study of Plotinus's sources, thought, and influence.Because they address philosophical questions from a comprehensive metaphysical framework, Plotinus's treatises are difficult to group systematically. The same is true of the contributions of this volume, which elude the editors' attempts to classify them into sections. The first three essays are on historical topics. Eric Perl presents examples of how Plotinus creatively reworks material from Plato and Aristotle. Sebastian Gertz explores Plotinus's knowledge of Gnosticism, outlines his criticism of it in II.9, and speculates on whether certain criticisms were meant to apply to Christianity as well. Marije Martijn summarizes the critical reception and development of Plotinus's ideas in later pagan Neoplatonism. Little connection is made between Plotinus and the preceding Platonic and Pythagorean revivals, and nothing more is said about his reception.The order of the remaining essays is generally the inverse of Porphyry's arrangement of the Enneads, insofar as they move from the first principle downward to conclude with humanity's place in the whole. In her interpretation of Plotinus's first principle, Gwenaëlle Aubry presents the power of the One as an intermediary between it and its effects. Unlike Perl, who depicts the One as pure activity, and Gatti, who in the 1996 volume said the One is self-creative freedom, Aubry denies both freedom and activity to the One. Mauro Bonazzi and Christian Tornau both cover Plotinus's account of the divine intellect that is identical with the Forms as a response to the challenge of skepticism. Bonazzi begins with the Middle Platonic debate over Plato's first principles, while Tornau works upward from how our participation in Intellect enables us to judge the truth of sense perceptions. Svelta Slaveva-Griffin tries to show how Number is a metaphysical principle for Plotinus, suggesting that there is participated One posterior to the transcendent One. Michael Griffin rediscovers Plotinus's important place in the late antique development of Aristotle's logic. Griffin summarizes his criticisms of Aristotle's categories as being inconsistent with Aristotle's own logical principles, and then presents Plotinus's own categories (really more like transcendentals) of intelligible being and then of sensibles. Similarly, D. M. Hutchinsin's summary of Plotinus on the composition of sensible bodies highlights [End Page 349] Plotinus's valid probing of the relation between the predicables and the categories, even if Plotinus himself would reduce bodies to heaps or bundles of qualities. Damian Caluori insightfully reconstructs Plotinus's account of body–soul relations and operations as a synthesis of Aristotelian principles, Galen's anatomical discoveries, and his own understanding of the soul as an active intelligible reality. Plotinus is far more concerned about the distinct nature of bodily reality than he is often given credit for. Transcending the narrow historical focus of this volume, Pauliina Remes meditates upon and praises Plotinus's contributions to the philosophical problem of self-knowledge. Riccardo Chiaradonna ably summarizes III.7 "On Eternity and Time," but with no comments on the significance of Plotinus's teachings. James Wilberding questions whether Nature, which is the aspect of the World-Soul at work in giving the cosmos its life and form, should be considered its own level of reality (hypostasis). In his _Duino Elegies,_ Rainer Maria Rilke suggests that animals enjoy direct access to a realm of being—the open—concealed from humans by the workings of consciousness and self-consciousness. In his own reading of Rilke, Martin Heidegger reclaims the open as the proper domain of human existence but suggests that human life remains haunted by vestiges of an animal-like relation to its surroundings. Walter Benjamin, in turn, was to show that such vestiges—what Eric Santner calls the _creaturely_—have a biopolitical aspect: (...) they are linked to the processes that inscribe life in the realm of power and authority. Santner traces this theme of creaturely life from its poetic and philosophical beginnings in the first half of the twentieth century to the writings of the enigmatic German novelist W. G. Sebald. Sebald’s entire oeuvre, Santner argues, can be seen as an archive of creaturely life. For Sebald, the work on such an archive was inseparable from his understanding of what it means to engage ethically with another person’s history and pain, an engagement that transforms us from indifferent individuals into neighbors. An indispensable book for students of Sebald, _On Creaturely Life_ is also a significant contribution to critical theory. (shrink)

This paper explores how image worship was conceptualized and represented by Chinese authors during the first four centuries of Buddhist presence in China. Previous scholarship has argued that image worship was initially seen in China as a distinctively Buddhist practice, so much so that Buddhism was even known to the Chinese as the “Religion of Images”. By examining the history of the interpretation of this term, the evolution of stories about sacred images, and the presentation of image worship in debates (...) about the compatibility of Buddhism with Chinese culture, I will argue that image worship was first seen as a distinctly Buddhist or non-Chinese practice only in the late fifth century. Ironically, image worship came to be seen or represented as “foreign” only long after it had already become part of most forms of Chinese religion. (shrink)

Friendship between professors and students have the potential for hurting those involved and can be hurtful to the larger society in which they occur. This paper examines what sort of boundary lines can be drawn for appropriate faculty-student relationships by considering three arguments against faculty-student friendships. After rejecting these arguments on the grounds that they rely upon a flawed conceptualization of friendship, the paper, drawing on William Rawlins’s theory of friendship, argues that faculty-student relationships are neither desirable nor undesirable per (...) se. However, if such relationships do arise, it is possible that they can be conducted in an ethically responsible and professionally appropriate way. (shrink)

One critique of the early Daoist texts associated with Laozi and Zhuangzi is that they neglect the human and lack a proper sense of ethical personhood in maintaining the primacy of an impersonal dehumanizing “way.” This article offers a reconsideration of the appropriateness of such negative evaluations by exploring whether and to what extent the ethical sensibility unfolded in the Zhuangzi is aporetic, naturalistic, and/or religious. As an ethos of cultivating life and free and easy wandering by performatively enacting openness (...) and responsiveness to things in an immanent this-worldly context, the Zhuangzi is oriented toward the relational attunement of disposition and practice rather than toward metaphysics or religion in a transcendent sense. It consequently suggests an immanent anarchic ethics without principles while neither forgetting nor reifying the sacred and the mundane in its playful illumination of the biospiritual dynamics of cultivating life. The literature on the democratic legitimacy of judicial review and also on institutionalizing deliberative democracy neglects the possibility of employing juries rather than judges to determine bill-of-rights matters. This neglect is unfortunate, for there are findings emerging especially from deliberative polling that support the feasibility of such juries. Such feasibility would raise a new countermajoritarian concern with judicial review. The argument supporting this new concern also casts fresh light on the traditional countermajoritarian concern.

In “Was I Ever a Fetus?” I argued that, since each of us was once an unthinking fetus, psychological continuity cannot be necessary for us to persist through time. Baker claims that the argument is invalid, and that both the premise and the conclusion are false. I attempt to defend argument, premise, and conclusion against her objections.
